These Terms of Service ("Terms") govern your use of Pulse, a membership-retention tool for small fitness businesses. By creating an account or using Pulse, you agree to these Terms. If you don't agree, don't use Pulse.
Pulse lets you upload member data (from a CSV export) to get an AI-generated risk assessment for each member, track that risk over time, log outreach to at-risk members, and see revenue tied to member risk. See our Privacy Policy for how your data is handled.
You agree not to:
Pulse uses AI (via a third-party provider) to assess member risk and suggest retention actions. This is a decision-support tool, not a guarantee - AI-generated risk levels, reasons, and suggested actions can be wrong, incomplete, or miss context a human would catch. You're responsible for using your own judgment before acting on any suggestion, especially anything involving a member's payment, health, or legal situation.
You own the member data you upload. We process it on your behalf to provide the service, and don't use it for our own purposes or sell it - see the Privacy Policy for details. You're responsible for having the right to upload and process that data (e.g. under your own privacy policy with your members, and any local data protection law that applies to you).
[Pulse doesn't currently have billing built into the product - fees are handled outside the app. Once that changes, describe your pricing, billing cycle, and what happens on non-payment here.]
We aim to keep Pulse available and your data intact, but Pulse is provided "as is" without a guaranteed uptime or availability commitment today. We take reasonable steps to back up data, but you're encouraged to periodically export your own data (the CRM and Trends tabs both support CSV export) as an extra safeguard.
[If you later commit to a specific uptime/SLA, state it here instead.]
[This section carries real legal weight and should be written or reviewed by a lawyer rather than left as a generic draft - it typically caps what a customer could claim from you if something goes wrong (e.g. data loss, service downtime, a bad AI suggestion acted on). A common starting structure: disclaim indirect/consequential damages, and cap direct damages at fees paid in a recent period - but the right shape depends on your risk tolerance and jurisdiction.]
You can stop using Pulse at any time. We can suspend or terminate an account that violates these Terms, is used for abusive/unlawful activity, or (once billing exists) has unpaid fees. On termination, you can request an export of your data within [X days] before it's deleted.
If we make material changes, we'll update the date at the top of this page and, where appropriate, let account holders know directly.
[State which jurisdiction's law governs these Terms - typically wherever your business is legally based.]
